1. Your Account
When you make a purchase from the Site, you may create an account as part of the checkout process. You are responsible for keeping your password and access confidential. You further agree to accept responsibility for and payment of all purchases and activities that occur under your account.
2. Acceptance of Order
Your placement of an order does not necessarily assure that we will accept your order. LumiTea reserves the right to refuse any order in its sole discretion. Additionally, before accepting your order, we may require further information if you have not provided all of the information required by us to complete your order. We must receive properly completed orders, authorize your form of payment, accept your order, and then we will place your order in line for shipment.
3. Pricing and Availability
All prices for products (and any additional costs of shipping and tax) are shown in U.S. dollars (USD). All products are subject to availability and supply. We reserve the right to, in our sole discretion, set quantity limits on any order, to reject all or part of an order, and/or to discontinue products without prior notice, even if you have already placed your order. Prices on every product are subject to change without prior notice, and you agree that taxes may be adjusted accordingly, and may be different from the amount shown on the payment screens. Several factors may cause this, such as variances between processor programs and changes in tax rates.
4. Payment Terms
LumiTea currently accepts Paypal, Visa, MasterCard, American Express and Discover credit cards. By submitting your order, you certify that you are authorized to use the designated credit card and authorize us to charge your order (including taxes, shipping and handling) to that card. If the card cannot be verified, is invalid or is otherwise rejected, your order may be suspended or cancelled automatically.
5. Shipping Terms and Policies
We strive to ship all orders for current in-stock items within one (1) business day. Our standard business hours are Monday through Thursday, 10 a.m. to 9 p.m. Eastern Standard Time, and Friday 10 a.m. to 8 p.m. Eastern Standard Time. Standard shipping is typically via the U.S. Postal Service (USPS) and you should allow three (3) to five (5) business days for delivery within the U.S. and ten (10) to fourteen (14) business days for International delivery once an order has been shipped. We reserve the right to substitute another carrier of equal or lesser cost to deliver your order. Please select expedited shipping, at additional cost, during checkout if you desire that shipping method.
Standard shipping is FREE OF CHARGE to destinations within the U.S. International priority Airmail is FREE OF CHARGE to destination outside the U.S. Should you select expedited shipping, the charge will be included on your invoice and can be viewed prior to finalizing your order. Expedited shipping charges are subject to change without prior notice
Title to products passes from LumiTea to you upon shipment and we are not responsible for any shipping delays or problems once the product has been shipped.
6. Back Orders
If for any reason an item on your order is temporarily out of stock, we will back order that item for you and ship the other merchandise immediately. Items on backorder will be charged only when the items are actually shipped, along with applicable taxes and any shipping charges.
7. Return and Exchange Policies
LumiTea is committed to ensuring the highest standard of health and safety in our products. For this reason, we have extremely secure quality control standards and cannot refund shipments that are sent back, refused, or marked “return to sender.” Any package sent back that is marked “return to sender” or “refused” is disposed of and we do not re-use or re-sell them. As soon as an order ships from our warehouse, it is a final sale to ensure your health and safety. What do I do if my order is incomplete, incorrect or damaged?
If you order is incomplete or incorrect please contact us via email. Please include in the subject line your complete order number. We take every measure to ensure a safe, complete, and undamaged order. We cannot guarantee that it will arrive in perfect condition due to the U.S. Postal Service or shipment provider conditions. Once the shipment carrier updates the order status to delivered, the risk of damages to, or loss of the item is at your own risk. Our Customer Service hours are Monday – Thursday, 10 a.m. to 9 p.m. EST and Friday, 10 a.m. to 8 p.m. EST.

We strive to be as accurate as possible; however, we do not warrant that all product descriptions, photographs, pricing, or other information on the Site is completely accurate, current, or error-free. Additionally, all weights and size dimensions are approximate. If one of our offered products is not as described or pictured, you may return it in an unused condition for a refund or exchange for another product. Should there be an error, whether on the Site, in an order confirmation, in processing an order, in delivering a product or otherwise, we reserve the right to correct such error and revise your order accordingly, or to cancel the order and refund any amount charged. In the event of an error, you may cancel your order and obtain a refund.

TO THE FULL EXTENT PERMITTED BY LAW, LUMITEA'S LIABILITY SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID FOR THE PURCHASE OF PRODUCTS FROM THIS SITE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
LumiTea products may be returned or exchanged according to the policies described above. THIS IS THE ONLY GUARANTEE OR WARRANTY FROM LUMITEA RELATING TO THE PRODUCTS YOU PURCHASE. LUMITEA MAKES NO OTHER, AND EXPRESSLY DISCLAIMS ALL, REPRESENTATIONS, WARRANTIES, AND CONDITIONS, WHETHER IN WRITING, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE, OR ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. PRODUCTS ARE PROVIDED BY LUMITEA "AS IS" AND WITHOUT WARRANTY OF ANY KIND.
12. Governing Law; Venue
These Terms of Sale and your purchase of products from LumiTea through the Site shall be governed and construed in accordance with the laws of the State of Florida. You agree that any action at law or in equity arising out of or relating to these Terms of Sale or your purchase of products shall be filed only in the state and federal courts located in Miami Dade County, Florida, and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action or proceeding arising out of these Terms of Sale.
